Screen solar potential before pricing a lease
Evaluate grid access, the option period, operating rent and restoration obligations separately.
Landosaur research · Updated 2026-10-01An open field near electrical infrastructure can be worth investigating for solar development, but proximity alone does not establish a viable project. Grid connection, usable layout, approvals and commercial terms determine whether interest becomes an operating lease. Keep speculative potential separate from contracted income.
Evaluate the development path
Request a clear description of the proposed footprint, access, equipment, connection point and development schedule. Ask which studies, interconnection steps and permits remain, who pays for them and what can prevent the project from proceeding. Do not infer available grid capacity from a line visible on an aerial map.
Penn State Extension’s landowner guide describes the solar development and leasing process, including option periods and the importance of transmission access and contract terms. Its Pennsylvania context is useful background; local approvals and a particular developer’s proposal need their own review. Penn State solar-leasing guide.
Pennsylvania DEP’s landowner resource hub points owners to information on letters of intent, options, leases and purchase agreements. Those are different stages of commitment and should remain separate in your property record. Pennsylvania DEP landowner resources.
Separate option income from operating rent
An option may reserve rights while the developer investigates the project. Identify the option payment, length, extension rights, activities permitted and restrictions on your own use during that period. Ask what happens if the project does not proceed and how any disturbance will be repaired.
For the operating phase, review the rent basis, acreage definition, escalation, commencement trigger, duration, extensions, assignment, lender rights and default provisions. Have counsel explain whether the developer controls important elections and how obligations are secured. A quoted annual rent is not enough to value the entire agreement.
Model coexistence and restoration
Investigate effects on current leases, farm operations, drainage, access, taxes, insurance and neighboring uses. If agricultural use is proposed alongside panels, request a specific operating plan with responsibilities and costs rather than assuming compatibility from the word “agrivoltaics.”
Ask how decommissioning, equipment removal, soil restoration and financial assurance are addressed. Identify the party responsible at the end of the term or after early failure, the standard of restoration and how the required funds or security are maintained. Review this alongside local requirements and the owner’s long-term plans.
A hypothetical underwriting error
Suppose a buyer sees a nonbinding expression of developer interest and capitalizes a possible future lease payment into today’s purchase price. That calculation omits the chance of failed interconnection, permitting delays or no executed lease. A more useful model shows the current property case, a conditional option case and a separately documented operating case.
Use analysis to keep those stages distinct and services to organize legal, engineering and tax review. The goal is to price the rights and commitments that exist now, while preserving potential upside as a clearly conditional scenario rather than promised passive income.
